PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE ACCESSING OR USING THE PLATFORM.
1. ACCEPTANCE OF AGREEMENT
1.1. By accessing, registering an account on, or using WhaleBet ("the Platform"), you explicitly acknowledge that you have read, understood, and unreservedly agreed to be bound by these Terms of Service.
1.2. If you do not agree to every clause of this agreement, you must immediately disconnect from and cease all use of the Platform.
1.3. The Platform is offered strictly to individuals who are at least 18 years of age (or the legal age of majority in their respective jurisdiction).
2. CRYPTO-ONLY OPERATIONS & BLOCKCHAIN FINALITY
2.1. Purely Digital Asset Economy: WhaleBet operates entirely via decentralized cryptographic tokens and digital assets (e.g., USDT, USDC, or other supported blockchain assets). No fiat currency (USD, EUR, etc.) is accepted, held, or processed directly by the Platform.
2.2. Irreversibility of Blockchain Transactions: All cryptocurrency deposits and withdrawals are executed on public, immutable distributed ledgers. Users acknowledge that blockchain transactions are final and irreversible. WhaleBet bears zero liability for user error, including sending funds to incorrect wallet addresses, selecting incompatible blockchain networks (e.g., ERC-20 vs. TRC-20), or losing private recovery keys.
2.3. Network Fees & Delays: Users are solely responsible for all blockchain network miner fees, gas fees, or transfer costs associated with deposits and withdrawals. The Platform is not liable for delayed transactions caused by network congestion or validator queue lags.
3. RAKE-FREE STRUCTURE & PLATFORM FEES
3.1. Zero Rake Policy: WhaleBet operates a strictly rake-free poker ecosystem. The Platform does not take a percentage cut ("rake") from any cash game pot, hand, or player-to-player contest. 100% of the chips in every active poker pot are distributed entirely to the winning hand(s).
3.2. Sustainable Operating Fees: To maintain server infrastructure and security, the Platform sustains operations exclusively through transparent, flat structural fees disclosed upfront, including:
- Hourly Seat Fees / Time-Based Billing: Automatic deductions from active seated balances based on the specific stakes room.
- Tournament Entry Fees: Fixed administrative overhead percentages added to Sit & Go (SnG) or scheduled event tickets.
- Private Table Creation Fees: Flat setup costs for custom password-protected rooms.
4. USER ELIGIBILITY & JURISDICTIONAL COMPLIANCE
4.1. User Responsibility: It is your sole, absolute responsibility to determine whether interacting with crypto-denominated, skill-based, or gaming platforms is legal under the laws of your physical location or residency.
4.2. Prohibited Jurisdictions: Users residing in regions, states, or countries where online gaming or cryptocurrency utilization is strictly prohibited by local statutes are barred from accessing the Platform. The Platform reserves the right to geo-block or terminate accounts originating from restricted regions without prior notice.
5. ACCOUNT SECURITY & ANONYMITY
5.1. Self-Custody & Credentials: Users are entirely responsible for safeguarding their login credentials, passwords, and private account tokens. WhaleBet does not store plaintext passwords and cannot recover accounts tied to lost credentials.
5.2. No-KYC & Pseudonymous Environment: WhaleBet does not mandate traditional Know-Your-Customer (KYC) document uploads. Consequently, users acknowledge that account recovery is impossible if credentials are compromised due to user negligence.
6. GAME INTEGRITY, COLLUSION & ANTI-FRAUD
6.1. Fair Play Enforcement: Soft-play, chip-dumping, multi-accounting, bot utilization, screen-scraping tools, and player collusion are strictly prohibited.
6.2. Right to Freeze & Audit: The Platform reserves the right to monitor table behavior, hand histories, and betting patterns. If automated security heuristics or manual audits detect collusive play, bot scripting, or system exploits, WhaleBet maintains the absolute right to freeze accounts, void active hands, and confiscate disputed balances.
7. LIMITATION OF LIABILITY & "AS-IS" DISCLAIMER
7.1. "As-Is" Delivery: The Platform, code architecture, web applications, and poker engines are provided on an "AS-IS" and "AS-AVAILABLE" basis without warranties of any kind, whether express or implied.
7.2. Exclusion of Liability: To the maximum extent permitted by applicable law, WhaleBet, its developers, operators, and affiliates shall not be held liable for any direct, indirect, incidental, special, consequential, or punitive damages—including loss of profits, loss of data, or digital asset devaluation—arising from server downtime, software bugs, blockchain connection failures, or user error.
8. MODIFICATIONS TO TERMS
8.1. WhaleBet reserves the right to modify, amend, or update these Terms of Service at any time at its sole discretion. Changes take effect immediately upon publication on the Platform interface. Continued use of the site following any update constitutes formal acceptance of the revised terms.
